Officers were called to a popular walkway crossing Joes Creek on Beach Road just before 9am on April 18 after a passerby reported a body in the water.
Police established a crime scene at the creek, which runs between Birdland Animal Park and the Big 4 caravan park.
Batemans Bay SES volunteers helped police retrieve the middle-aged man from the water at 10.20am. The task was made more difficult by the number of young families and cyclists in the area.
Far South Coast LAC Detective Inspector Angela Burnell said it was too early to determine the cause of death.
“We can confirm a deceased male has been located,” Inspector Burnell said.
“At this stage we are very early into the investigations. We require a full crime scene examination and full examinations of the deceased to determine any other factors.”
It was not known how long the body had been in the water.
