A Batemans Bay man who assaulted his partner and kicked her out of his home without clothes after being refused sex will be sentenced in the District Court later this year.

The man, who we can't name for legal reasons, pleaded guilty to several offences in Batemans Bay Local Court this week. Several other charges against the man were dropped by the DPP.
He will be sentenced in the District Court later this year on three counts of contravening an AVO, common assault, assault occasioning actual bodily harm, sexually touching a person without consent, destroying or damaging property, and aggravated break and enter.
According to a set of agreed facts tendered to the court by the DPP prosecutor, the victim in the matters took an AVO out against the man late last year which banned him from contacting her.
The facts state that despite this, the man and his victim were at his address in Batemans Bay on December 21, 2020, when they decided to go to another address in Batemans Bay.
When they got to the car, the man took a pair of the victim's shoes from the passenger's side, starting an argument that culminated in the man pushing a didgeridoo into her face.
The facts state the man and his victim went for a drive together two days later, and eventually parked a car out the front of his address at about 2am on December 24.
The victim got out of the car through the passenger's door, then went back to the back seat to retrieve personal belongings. When she was bent over, the man touched her in a sexual manner without consent.
The facts state that later in the man's unit, he asked the woman to have sex with him, and an argument started when she said no.
The man the dragged the woman to the ground using a bandana around her neck and dragged her around the apartment before sticking his fingers in her mouth, causing her to bleed. He told the victim he'd kill her if she went to the police before ripping her clothes off her body and forcing her outside.
The victim obtained a towel from a neighbouring property and called police using a public payphone near the man's address.
The man then drove to the victim's home again at about 2.30am on March 4, 2021, and became angry when she wouldn't let him inside. He kicked the victim's front door in and entered the home before another woman removed him from the premises.
Police arrested the man shortly after the last incident, and he has been remanded in custody ever since.
The man appeared in Batemans Bay Local Court this week via AVL where he was committed to appear in Nowra District Court later this year for sentencing.
