A height variation was approved by the Eurobodalla Shire Council in August for the building to stand just over 20 metres tall - five metres taller than the LEP limit.
The L-shaped plans include a complex of four, five and six storeys with a basement car park of 93 spaces.
It would include 16 x 1 bedroom, 32 x 2 bedroom, 18 x 3 bedroom and 1 x 4 bedroom apartments.
The site has a 60-metre frontage to Beach Road with views of the Clyde River, Batemans Bay Town Centre and the ocean.
