Eurobodalla Shire Council approved the development application for a five-storey apartment block with parking and a cafe at the old Westpac bank site, on Tuesday, August 25.
The proposed development would be 14.4 metres high, despite councils Local Environment Plan listing a height limit of 12 metres for shire.
Mayor Lindsay Brown said councillors voted to allow the exception because the extra height was needed to accommodate a lift in the building.
All councilors who attended the Tuesday meeting voted in favour of the motion and spoke in support of the development.
Cr Milton Leslight was absent.
