WE bought Lot 163 Warragai Place Malua Bay because it had a riparian reserve creek zoned ‘6a1 open public space’, the natural habitat environment of the endangered and protected yellow-bellied glider, at our back boundary.

One side boundary was a managed public reserve, which joined the riparian corridor.
This potentially idyllic nature park environment has suddenly been snatched away from us by four councillors who knowingly gave consent to an integrated high density housing complex of three or more dwellings on one lot.
The developers have legally been given authority to remove any trees under NSW 10/50 clearance code in the riparian corridor within 10 metres of any of their dwellings.
In addition council has authorised them to remove trees within three metres of decks permitted to be built on the so-called protected riparian corridor.
Council has also rezoned the riparian corridor from 6a1, to R2 residential without notifying us direct before doing so.
The developers did not have to remove the threatened trees but they chose do so and potentially can legally clear to their boundary fence “legally”, according to Lindsay Usher’s letter dated January 15, wiping out the habitat of the endangered species.
Dave Brewer, the project manager, contrary to his claims on page 8 of January 16’s Bay Post, is obviously in the business of unnecessarily cutting down trees on riparian corridors as witnessed on Monday January 19.
Also, I was invited by his builder, Mr Ralston, onto Lot 73 and was not trespassing as he claimed.
The councillors and the developers responsible should be accountable for their environmental vandalism and council are invited to explain why instrument 88b did not protect the trees on Lots 71, 72 and 73 and instigate a biodiversity study to map and record the local habitat of the endangered species yellow-bellied glider as soon as possible.
Councillors, how can the above saga of heart-
ache encourage people to come and live happily and harmoniously in the Eurobodalla Shire?
