Consuming cannabis left a nasty taste in a motorist’s mouth when he appeared before Batemans Bay Local Court earlier this month.
Andrew Michael Stark, aged 40, of Crag Road, Batehaven, was stopped for a random breath test on Beach Road on June 30.
The breath test returned a negative reading but an oral fluid test had a positive reaction to cannabis.
The defendant was arrested and taken to a nearby drug bus for a second test.
The sample, sent to a laboratory for analysis, proved positive to cannabis.
Police facts said Mr Stark told police officers he had consumed cannabis within a few days before the offence.
Mr Stark, who pleaded guilty to driving a vehicle with an illicit drug present in his blood, was convicted of the offence on October 13, fined $400 and disqualified from driving for three months.
Offender on community service
A community service order in lieu of a jail sentence and fines were ordered for Peter Graeme White, of Ridge Road, Catalina, in Batemans Bay Local Court this month.
The defendant, 44, was on October 13 found guilty of common assault, possessing ammunition without a licence, possessing an unauthorised prohibited firearm, and having a knife in a public place.
The offences, which took place in late August, will cost the defendant 150 hours of his free time while he serves a community service order on the assault and firearm charges and a $1000 fine for the ammunition and knife charges.
Surfers for woman on sex assault charges
A woman facing charges of aggravated sexual and indecent assault sought a variation in her bail in Batemans Bay Local Court on Monday so she could holiday at Surfers Paradise over Christmas and New Year.
Doreen Seymour, and her co-accused, Trent John Andrew Bond, were charged in June, she on the 23rd, and he on the 22nd.
Ms Seymour was charged with three offences – aggravated sexual assault in company with another person, aggravated indecent assault in company, and common assault – and was granted bail.
Mr Bond, who was refused bail and taken into custody, was charged with aggravated sexual assault in company with another person, three counts of aggravated indecent assault in company, and inciting aggravated indecency in company.
Magistrate Doug Dick granted Ms Seymour’s bail variation and set the matters down for a telephone callover in Bega Court on December 10.
Adjournment for man accused of perjury, intimidating police
Robert Bruce Hunt was not present in Batemans Bay Local Court on Monday when his case was adjourned to December 5.
Charged with perjury to procure a conviction/acquittal in a serious offence, two counts of making a false statement on oath amounting to perjury, and intimidating a police officer in the execution of his duty, the defendant was also granted a variation in his bail conditions to report to Moruya police instead of Batemans Bay police.
