A THREAT of jail time if there was a next time was aimed at a defendant by the presiding magistrate at Batemans Bay Local Court on September 8.

Sharon Lee Whalley, of Valley Road, Sunshine Bay, was unrepresented by counsel when she pleaded guilty to a charge of driving with a middle-range prescribed concentration of alcohol on the evening of August 2.
After a positive reading was detected by a random breath test on Beach Road, Ms Whalley then recorded a PCA of 0.148 at the police station.
Police facts tendered to the court stated that she was “moderately affected by alcohol during her time in police custody”.
The defendant told police she had consumed about five glasses of white wine.
The court heard that Ms Whalley was placed on a 12-month good behaviour bond for a low-range PCA in January 2013, and when she was arrested on August 2 her licence was immediately suspended.
When asked by Magistrate Doug Dick what had happened, she replied that she “didn’t know”.
Mr Dick convicted Ms Whalley of the offence, backdated her 12-month driving disqualification to August 2 and fined her $1400.
“If you get caught again, you will be looking at jail,” Mr Dick said.
