Police facts state that Jason Athol Callaghan, 36, who had lived in Clare Crescent but was homeless at the time of the incident, was seen by police driving east on South Street, Batemans Bay at 10.50pm on May 30.
He turned right into Gregory Street and then stopped in a driveway in that street, where he was spoken to by police.
They asked him if he lived there, and he replied “na, I’m homeless at the moment”.
A breath-test was positive and he was arrested and taken to Batemans Bay Police Station. Mr Callaghan admitted to having drunk 17 stubbies of VB at a Moruya Hotel between the 4pm and 10pm.
His breath analysis reading was 0.159. Police formed the opinion he was moderately affected by alcohol.
The court heard that Callaghan had moved to Bathurst.
He was convicted, fined $1500 and disqualified from driving for 12 months
