Council declined to comment when contacted by the Bay Post/Moruya Examiner on Wednesday, July 18, after Justice Malcolm Craig endorsed the council’s assessment of a disputed development application.
The ruling upheld council’s approval of the 30-lot subdivision in Malua Bay after it was challenged by local residents.
In a media release issued on Tuesday afternoon, mayor Lindsay Brown said the decision by the courts was important for council.
“In his determination Justice Craig was comfortable that council had considered the environmental impacts of the development,” Cr Brown said.
“The judgement recognises that council identifies land that is appropriate for development and considers all the relevant environmental factors.”
Cr Brown said the council’s planning instruments identified areas for future development within, or next to, townships, to maximise the use of local infrastructure and commercial areas and to avoid placing pressure on undeveloped parts of the shire.
“It is important that council’s planning instruments enable developments to proceed in order to accommodate our growing community,” Cr Brown said.
“The decision handed down by Justice Craig is positive because it gives developers confidence that our planning assessment process is robust.”
