Magistrate Chris Bone sentenced Cory Dallas Maddison, 29, to three months’ jail following an incident on March 8 this year.
The labourer was caught drink-driving and driving while disqualified after a night out in Batemans Bay.
The court was told Mr Maddison’s girlfriend drove him into Batemans Bay at 6pm on March 7 and he spent a considerable time drinking.
At 2.45am the following morning Mr Maddison was driving in town. Police drove past him and did a U-turn.
The police followed, turning on their lights and siren to pull him over.
Mr Maddison admitted he had been drinking and recorded a breath-test result of 0.145. He had been disqualified from driving in late 2008.
His solicitor, Sam Kibby, argued that Mr Maddison’s mother required his assistance in caring for his nephew, and said he had experienced a transformation in character. This was shown by references from his football club and by the fact that his girlfriend was pregnant and expecting a child in December.
Mr Bone noted the defendant’s previous record included two mid-range drink-driving offences in 2004 and 2008. He said the offences were common enough and showed an element of contempt.
Mr Maddison was sentenced to three months’ jail for each of the two offences, to be served
concurrently. He has appealed the severity of the sentence and will appear before Nowra District Court on August 31.
