Janmhar Getuya, 29, was charged with 11 offences on August 14 last year and was remanded in custody at Goulburn Jail three days later.
On Monday January 25, he appeared before Batemans Bay Local Court via video link.
“Your solicitor is not here today but he wants an adjournment, and so does the prosecution, but I’m not happy,” Magistrate Chris Bone said.
“It’s almost getting to an intolerable situation when you have a man in custody for over six months and you still don’t have a brief.
“I’m very concerned that I am keeping some bloke in custody for a drug offence when we don’t even know if it was a drug yet.”
At the time, Mr Bone put the case over for four days and said: “Unless something definite comes to me, I’m going to have to give the bloke bail”.
However, it took just two days.
On January 27 the Department of Public Prosecutions mentioned the case and presented sufficient evidence for the case to be adjourned to February 22.
Mr Getuya’s bail conditions were continued and he will reappear via video link from Goulburn Jail.
